On Location Events Terms & Conditions

In the following terms & conditions, “the photographer” shall mean On Location Events also known as On Location Events Photography. “The clients” shall be those persons/companies defined as the booker of the contract. These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed by the photographer in writing.

Copyright

Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files, or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically or electronically or by any other means, an image created as part of this contract without the permission of the Photographer/s in writing.

License

The Photographer/s shall be granted artistic license in relation to the poses photographed and the locations used. The Photographers judgment regarding the locations/poses and number of images taken shall be deemed correct.

Attendance

In the unlikely event of the assigned Photographer being unable to attend your photo assignment due to unforeseen circumstances, we reserve the right to appoint another photographer to attend your photo assignment on our behalf to undertake the photo assignment photography to his/her best ability.

Limitation of Liability

In the unlikely event of total photographic failure or cancellation of this verbal or written contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

On Location Events takes care with respect to the exposure, transportation, and processing of images, including the use of professional equipment and professional backup equipment.  However, in the unlikely event of the client(s) photographs are lost, stolen, or destroyed for reasons within or beyond On Location Events control, the liability is limited to the return of all payments received for the contracted package described in your agreement booking. Your statutory rights are not affected. On Location Events has full public liability and professional indemnity insurance. The total limit of liability shall not exceed the total package price stated in the agreement booking.

Cancellation

In the event that On Location Events cannot attend for any reason beyond their control, death, accident or illness or for any other reason then On Location Events will not be liable to compensate the client except to return any monies paid to date. In this event On Location Events will make every effort possible to provide a substitute photographer of similar skills and experience.

If the client(s) should have to cancel a booking the following cancellation fees will become due immediately upon cancellation:
Within 30 days of the event 50% of the value.
Within 14 days of the event 100% of the value.

Negatives/Digital Files

Negatives / digital files remain the property of On Location Events.

Prices

All prices are subject to the current rate of V.A.T. (if applicable).

Display & Model Release

On Location Events may use images from the shoot to help promote our business, images may be used on any of our social media platforms, marketing material, or any of our websites.
